State Government And Legislative Framework

West Virginia legislation is codified in the West Virginia Code. Administrative regulations are published through the Secretary of State's Code of State Rules. Both should be checked because many operational event requirements are found in legislative rules rather than statutes.

Section 02

Mass Gatherings And Public Assemblies

West Virginia has a particularly important state public-health mass-gathering framework within 64 CSR 18, General Sanitation.

The active rule defines a mass gathering as 250 or more persons assembled for a meeting, festival, social gathering, concert or similar purpose. It excludes an assembly occurring in permanent buildings or permanent structures specifically designed, equipped and intended for large numbers of people. This distinction means a large outdoor festival or temporary event can fall within the mass-gathering provisions even though a conventional permanent arena may not fall within that particular definition.

The rule treats fairs, festivals and mass gatherings as recreational facilities for regulatory purposes. The active provisions reviewed include requirements for health permits, site sanitation, sewage and refuse arrangements, potable water, toilet provision, site density and parking. A health officer can inspect covered premises and exercise enforcement powers.

For mass gatherings, the rule establishes minimum usable site area of 20 square feet per person for daytime gatherings and 40 square feet per person where people remain overnight, excluding parking areas. Parking is to be sufficient for approximately one vehicle per four persons, subject to specified maximum parking densities.

The active rule also contains a mass-gathering toilet formula: generally one water closet per 100 persons for the first 1,000 persons, with two additional water closets for each additional 1,000 persons, together with associated lavatory requirements where water under pressure is provided. Urinals can substitute for part of the water-closet requirement within the limits stated by the rule. These figures should be checked against the current rule and the responsible health officer during event design because an amendment to 64 CSR 18 was in progress during this research.

Section 03

Fire And Life Safety

West Virginia's fire-code position must not be confused with states that simply adopt the International Fire Code locally.

The West Virginia Fire Code, 87 CSR 1, is a state legislative rule. The active version became effective 1 July 2026. It adopts NFPA-based fire and life-safety standards, including NFPA 1 and NFPA 101, subject to West Virginia amendments and precedence provisions.

This is highly relevant to assembly occupancies, exits, occupant load, fire-department access, combustible materials, temporary arrangements, cooking, electrical issues, fire protection and emergency procedures. Unlike the State Building Code, the Fire Code is not merely a model code waiting for local adoption.

The current rule also contains West Virginia-specific assembly-event requirements. Event operators should therefore assess both the incorporated NFPA requirements and the express West Virginia amendments rather than relying on a generic IFC checklist.

Section 04

Building Codes And Assembly Occupancies

West Virginia's building-code system is materially different from its fire-code system.

The State Fire Commission promulgates the technical State Building Code, but statute expressly provides that the code has force and effect in counties and municipalities that adopt it. Enforcement is the responsibility of the respective local jurisdiction.

The active 87 CSR 4 version is dated 1 August 2022. The Secretary of State also records a newer rule as “In Progress,” so organizers and design professionals should confirm whether that amendment has become effective before relying on the 2022 version in future projects.

The active framework incorporates ICC standards including the International Building Code. Consequently, where adopted locally, assembly classifications, structural loads, temporary stages, platforms, bleachers, grandstands, accessible design and means of egress may be regulated through the State Building Code.

Emergency Management

West Virginia Emergency Management Division coordinates statewide preparedness, response, recovery and mitigation and operates the State Emergency Operations Center when activated. Direct emergency assistance remains heavily dependent on county and local emergency-management agencies.

For significant festivals, concerts, races and sporting events, liaison with the county emergency manager may therefore be appropriate where severe weather, evacuation, mass casualty, resource coordination or multi-agency planning is foreseeable.

Emergency Medical Services

West Virginia regulates EMS agencies and personnel at state level, but this research did not identify a universal statewide event-medical staffing formula based solely on crowd size.

Organizers should distinguish between regulation of EMS providers and the question of how many ambulances, first-aid posts or medical personnel a particular event requires. The latter will commonly be determined through local EMS, health, venue, fire or special-event planning processes based on event risk.

Section 08

Public Health And Sanitation

Public-health regulation is a significant component of West Virginia event planning.

The General Sanitation rule addresses recreational facilities including fairs, festivals and mass gatherings and contains provisions dealing with sewage, toilets, potable water, refuse, premises safety and health-officer inspections.

Health permitting is therefore not simply a food-vendor issue. Outdoor mass gatherings and festival sites can themselves come within the public-health regulatory framework.

Food Safety And Temporary Food Events

Food concessions at festivals and other events are governed through West Virginia food-establishment law and health-department administration.

Mobile vendors have a particularly useful statewide licensing provision: a qualifying in-state mobile food establishment can receive a statewide permit from its home local/county health department. However, the statute expressly requires the vendor to notify the health department having jurisdiction at least 72 hours before operating in that jurisdiction, and that local department may impose conditions necessary to assure compliance with its rules and standards.

Temporary food operations that are not covered by the mobile statewide-permit provision should be checked with the local health department.

Alcohol Licensing

The West Virginia Alcohol Beverage Control Administration (ABCA) regulates alcoholic-beverage licensing.

Private Security Regulation

Private event-security services are regulated through the West Virginia Secretary of State.

The Secretary of State expressly states that persons or groups performing security-guard functions in West Virginia must be licensed unless a statutory exemption applies.

A distinction must be maintained between licensed private security personnel and sworn police officers. A security-guard licence does not convert private event personnel into law-enforcement officers or confer general police powers.

Section 12

Crowd Management

West Virginia does not rely on an adopted International Fire Code crowd-manager provision. Instead, crowd-management requirements must be traced through the State Fire Code's incorporation of NFPA 101 and other NFPA provisions.

Accordingly, assembly-event organizers should determine with the fire AHJ whether the incorporated NFPA crowd-manager provisions apply to their particular occupancy and occupant load.

The important point for professional planning is that crowd-manager obligations should not be assumed from the IFC: West Virginia's adopted fire-code route is different.

Temporary Structures

Temporary stages, roof structures, FOH structures, viewing platforms, towers, grandstands, bleachers and temporary seating can engage two regulatory layers:

the State Fire Code, applicable as a fire/life-safety framework; and

the State Building Code where adopted locally, with the local building official responsible for enforcement.

Tents And Membrane Structures

No separate West Virginia statewide event-tent webpage establishing a simple universal square-foot permit threshold was identified during this research.

Tents and membrane structures nevertheless remain subject to the adopted State Fire Code and incorporated NFPA requirements. Depending on the jurisdiction and event, the local fire marshal or State Fire Marshal may require inspection or approval, and locally adopted building-code requirements can also apply.

Matters to confirm with the AHJ include exits, occupant load, flame resistance, cooking, heating, generators, extinguishers, smoking, separation distances, emergency lighting and fire-department access.

Pyrotechnics And Fireworks

West Virginia has a clear state-level permitting system for public fireworks displays.

A municipality, county, fair association, amusement park or other organization must obtain a permit from the State Fire Marshal to present a public fireworks display. The statute requires an application, a fee not exceeding $50, proof of financial responsibility and other information required by rule. Written notice to local police and fire authorities is required at least five days before the display.

The display must be operated by a competent operator licensed or certified by the State Fire Marshal and must be safe in the opinion of the fire chief serving the locality.

Occupational Safety And Health

West Virginia is not an OSHA-approved State Plan state. Federal OSHA has jurisdiction over most private-sector employers in West Virginia. State and local government employees are outside federal OSHA jurisdiction.

West Virginia nevertheless operates a separate WV State OSHA Program through the Division of Labor for covered state agencies under state law. The state programme states that it adopted federal OSHA standards that were in effect on 15 April 1998 for covered state agencies. Other public entities may have an opt-in route.

This distinction is important at events involving private promoters, public authorities, municipal employees and contractors.

Roads, Highways And Traffic Management

The West Virginia Division of Highways controls state highway right-of-way and operates the state's encroachment-permit system.

Any parade, race, festival, filming activity, temporary access arrangement or road closure affecting a state-maintained highway should therefore be raised with WVDOT/Division of Highways rather than relying solely on municipal approval.

Traffic-control arrangements must also satisfy applicable highway standards, and police/traffic-control requirements can be imposed locally.

Accessibility

Federal ADA obligations apply separately, but West Virginia also has state civil-rights and accessibility provisions.

The West Virginia Human Rights Act prohibits a place of public accommodation from denying accommodations, advantages, facilities, privileges or services because of disability and other protected characteristics.

West Virginia's White Cane Law separately protects equal use of public places and public accommodations by people with disabilities and addresses service animals.

Section 24

Severe Weather And Environmental Hazards

West Virginia event planning should place particular emphasis on flash flooding/flooding, severe thunderstorms, lightning, tornadoes, extreme heat, winter weather, snow/ice and wildfire/forest-fire conditions.

No universal state event-weather cancellation threshold was identified. Weather monitoring and decision points should therefore be built into the event emergency plan and coordinated with the applicable local emergency-management and public-safety authorities.

Wildfire controls are more prescriptive. West Virginia has designated forest-fire seasons from 1 March through 31 May and 1 October through 31 December, during which outdoor burning is generally prohibited between 7:00 a.m. and 5:00 p.m., subject to statutory exceptions and additional restrictions.

Environmental Protection

West Virginia Department of Environmental Protection regulates air, water, waste and other environmental matters that can affect event sites.

Event-specific relevance can include spills, fuel storage, generator operations, wastewater, waste management, open burning and water pollution.

This research did not identify a general statewide event-noise permit. Event noise is therefore likely to be primarily a municipal/county ordinance issue unless another state environmental requirement is triggered.

Child Protection And Young Persons

For event operations, West Virginia child-labor rules are more immediately relevant than broad child-protection law.

The current Child Labor rule became effective 16 March 2026. Promoters employing minors in concessions, attractions, entertainment, setup or other temporary work should check permitted occupations, hours and hazardous-work restrictions.

Separate alcohol laws restrict youth access to alcohol-related work and sales.

Law Enforcement And Public Safety

West Virginia State Police is the principal statewide police agency and can provide statewide law-enforcement capability alongside county sheriffs and municipal police departments.

Operational event policing will nevertheless depend heavily upon location. Municipal events ordinarily work with municipal police; unincorporated locations can involve sheriff and State Police resources.

Counter-Terrorism And Protective Security

The principal West Virginia state-level intelligence/protective-security resource is the West Virginia Fusion Center.

The Fusion Center combines law enforcement, public safety and private-sector participation and supports collection, analysis and dissemination of intelligence relating to criminal activity, terrorism and all-hazards concerns. It also participates in Suspicious Activity Reporting.

For major events, venues and critical infrastructure, this is a useful state connection for protective-security information and suspicious-activity reporting rather than duplicating federal DHS material.

State Event Permits

West Virginia does not appear to operate a single state permit covering all public events.

Instead, direct state permits arise where an event uses particular state property or undertakes regulated activity—for example:

State Capitol events;

public fireworks displays;

amusement rides;

events affecting state highways;

marine races and parades;

health-regulated mass gatherings;

alcohol sales; and

activities on DNR-managed property.

A local special-event permit may therefore exist in addition to, rather than instead of, required state approvals.

State Parks And Public Lands

West Virginia Division of Natural Resources administers rules governing public use of state parks, forests and wildlife management areas.

No single statewide commercial-event application covering every DNR property was identified during this research. Event promoters should therefore contact the specific park or DNR property and obtain site-specific authorization in addition to complying with the public-use rule and any other state/local regulatory requirements.

Water Events

West Virginia has a particularly clear state permit provision for organized water events.

A person in charge of a proposed regatta, motorboat or other boat race, marine parade, tournament or exhibition on state waters must generally file an application with the DNR Director at least 15 days before the event and may not conduct the event without written authorization.

The statute also provides that a separate state permit under this section is not required where an applicable permit has already been obtained from an authorized federal agency, although applicable federal requirements still apply.

Aviation And Drone Considerations

Federal FAA requirements remain the principal aviation layer and are dealt with separately at federal level.

West Virginia nevertheless has state criminal provisions governing unmanned aircraft. State law prohibits certain intentional privacy invasions and harassment and prohibits operation with willful or wanton disregard for the safety of persons or property. It also addresses interference with official public-safety duties and certain operations involving targeted facilities.

No blanket statewide prohibition on drones at every public event or every state park was identified in this research. Property-specific restrictions and the landowner's permission should therefore be checked separately.

Incident Reporting And Accident Investigation

The clearest event-specific state accident-reporting regime identified is for amusement rides and attractions.

An owner or operator must notify the Division of Labor within 24 hours after a fatality or an accident caused by operation of a ride or attraction that results in serious physical injury requiring medical treatment or causes loss of consciousness. The Division investigates such incidents and safety-related complaints.

Other incidents can trigger separate reporting regimes—for example environmental spills, workplace incidents or fire investigations—depending on circumstances.

Legislation / Mandatory incident reporting.
Authority
West Virginia Legislature / Division of Labor.
Classification
Legislation / Mandatory incident reporting.
Relevance

Section 34

Insurance And Liability

No universal state law requiring every festival or public gathering to maintain a single prescribed amount of event liability insurance was identified.

However, specific regulated event activities do carry mandatory financial-responsibility requirements.

For amusement rides and attractions, West Virginia law requires approved insurance of at least $300,000 per person and $1 million aggregate for each amusement ride or attraction location, or an approved bond or other security in the same framework. Evidence must accompany the permit application.

Public fireworks-display permits also require proof of financial responsibility in the form and amount required by the State Fire Marshal, and the fireworks statute contains an additional operator-bond provision.

Private security firms are separately required to provide prescribed bond or liability-insurance documentation through the Secretary of State licensing process.

Section 35

County And Municipal Authority

The local regulatory layer is essential in West Virginia.

A promoter should not interpret compliance with state health, fire, alcohol, amusement-ride or other requirements as automatic authorization to hold an event.

Local authorities may regulate or administer:

special-event permits; use of public property; street closures; parades; local police deployment; fire inspections; building permits; temporary stages and structures; tents; occupancy; food-health coordination; sanitation; local emergency medical arrangements; parking and traffic; noise; zoning; signage; alcohol-area endorsement; and other operational matters.

Building-code jurisdiction is particularly important. State statute provides that the State Building Code becomes effective in counties and municipalities that adopt it, with enforcement undertaken locally.

W. Va. Code §7-1-3n — County Building-Code Authority

Legislation / Local-government authority.
Authority
West Virginia Legislature / County Commissions.

W. Va. Code §8-12-13 — Municipal Building Regulation

Legislation / Local-government authority.
Authority
West Virginia Legislature / Municipalities.

Legislation / Local-government authority.
Relevance

Gives municipalities authority over building regulation and permits adoption of the State Building Code. This confirms that municipal building officials can be a central AHJ for event structures and venue alterations.

AHJ
Operational application

Authority Having Jurisdiction — West Virginia Event Application

For practical event planning in West Virginia, the Authority Having Jurisdiction (AHJ) should be identified at the earliest planning stage.

Depending on the event, the AHJ or approving bodies can include the local fire marshal or State Fire Marshal; municipal or county building official; local/county health department; municipal police, county sheriff or West Virginia State Police; county emergency-management agency; local EMS authority; ABCA; Division of Labor; WVDOT; DNR; General Services where state property is involved; and the owner or manager of the venue.

This is particularly important because West Virginia combines:

a statewide Fire Code; a locally adopted/enforced State Building Code; state public-health mass-gathering rules; and numerous activity-specific state permits.

Consequently, an organizer can be compliant with one regulatory layer while still lacking permission under another.

West Virginia — Key Event-Safety Triggers

For rapid professional reference, the most important West Virginia-specific triggers identified are:

Mass gathering: 250 or more persons under 64 CSR 18, subject to the permanent-large-assembly exclusion.

Mass-gathering sanitation: specific state provisions for usable site area, toilets, parking, potable water, waste and sanitation.

State Fire Code: 87 CSR 1 is statewide; current version effective 1 July 2026.

Building Code: state technical code, but force and local enforcement depend on county/municipal adoption.

Crowd management: derive requirements through the State Fire Code's incorporated NFPA assembly/life-safety framework rather than assuming IFC provisions.

Food: state food rule plus local-health administration; qualifying in-state mobile vendors use a statewide permit but must give the destination health department at least 72 hours' notice.

Alcohol: dedicated fair/festival and multi-vendor event licence mechanisms exist.

Private security: commercial security guard functions are state licensed through the Secretary of State unless an exemption applies.

Fireworks: public displays require a State Fire Marshal permit, appropriate operator and financial responsibility.

Amusement rides: state permits/inspections, insurance and serious-incident reporting apply.

Water events: regattas, boat races and marine parades normally require DNR application at least 15 days in advance.

Capitol events: require General Services approval.

State highways: WVDOT approval is an additional layer where event activity affects state highway property.

Outdoor burning/wildfire: seasonal statewide burning restrictions are particularly relevant to outdoor events.

Local approval: remains essential for special events, roads, fire inspection, structures, parades, police, noise and other operational matters.
