West VirginiaCrowd Safety, Event Safety, Spectator Safety, Event Security and Public-Event Planning Reference
A structured state-level reference for legislation, life safety, public health, security, emergency management, temporary event infrastructure, permits and local authority interfaces affecting public events in West Virginia.
State Government And Legislative Framework
West Virginia legislation is codified in the West Virginia Code. Administrative regulations are published through the Secretary of State's Code of State Rules. Both should be checked because many operational event requirements are found in legislative rules rather than statutes.
West Virginia Code
Legislation / Statutory research portal.- Authority
- West Virginia Legislature.
- Classification
- Legislation / Statutory research portal.
Primary source for West Virginia statutes. Particularly relevant chapters include public health, fire prevention, Homeland Security, natural resources and boating, labor and amusement rides, alcohol, private security, local government and criminal provisions concerning unmanned aircraft.
West Virginia Code of State Rules
Regulation / Administrative-code database.- Authority
- West Virginia Secretary of State — Administrative Law Division.
- Classification
- Regulation / Administrative-code database.
Searchable official database for current, historical and in-progress West Virginia legislative rules. It is essential for determining the currently effective version of fire, building, health, EMS, food, child-labor and other rules. The database distinguishes active regulations from proposed or historical versions.
Mass Gatherings And Public Assemblies
West Virginia has a particularly important state public-health mass-gathering framework within 64 CSR 18, General Sanitation.
The active rule defines a mass gathering as 250 or more persons assembled for a meeting, festival, social gathering, concert or similar purpose. It excludes an assembly occurring in permanent buildings or permanent structures specifically designed, equipped and intended for large numbers of people. This distinction means a large outdoor festival or temporary event can fall within the mass-gathering provisions even though a conventional permanent arena may not fall within that particular definition.
The rule treats fairs, festivals and mass gatherings as recreational facilities for regulatory purposes. The active provisions reviewed include requirements for health permits, site sanitation, sewage and refuse arrangements, potable water, toilet provision, site density and parking. A health officer can inspect covered premises and exercise enforcement powers.
For mass gatherings, the rule establishes minimum usable site area of 20 square feet per person for daytime gatherings and 40 square feet per person where people remain overnight, excluding parking areas. Parking is to be sufficient for approximately one vehicle per four persons, subject to specified maximum parking densities.
The active rule also contains a mass-gathering toilet formula: generally one water closet per 100 persons for the first 1,000 persons, with two additional water closets for each additional 1,000 persons, together with associated lavatory requirements where water under pressure is provided. Urinals can substitute for part of the water-closet requirement within the limits stated by the rule. These figures should be checked against the current rule and the responsible health officer during event design because an amendment to 64 CSR 18 was in progress during this research.
64 CSR 18 — General Sanitation
Regulation / Mass-gathering and sanitation rule.- Authority
- West Virginia Department of Health / West Virginia Secretary of State.
- Classification
- Regulation / Mass-gathering and sanitation rule.
Core West Virginia event reference. Covers mass gatherings, festivals and other recreational facilities; defines the 250-person threshold; regulates permitting, health inspection, toilets, potable water, sewage, refuse, site density, parking and general sanitation. The Secretary of State records the 12 August 2013 version as the active rule while a replacement rule is in progress.
Fire And Life Safety
West Virginia's fire-code position must not be confused with states that simply adopt the International Fire Code locally.
The West Virginia Fire Code, 87 CSR 1, is a state legislative rule. The active version became effective 1 July 2026. It adopts NFPA-based fire and life-safety standards, including NFPA 1 and NFPA 101, subject to West Virginia amendments and precedence provisions.
This is highly relevant to assembly occupancies, exits, occupant load, fire-department access, combustible materials, temporary arrangements, cooking, electrical issues, fire protection and emergency procedures. Unlike the State Building Code, the Fire Code is not merely a model code waiting for local adoption.
The current rule also contains West Virginia-specific assembly-event requirements. Event operators should therefore assess both the incorporated NFPA requirements and the express West Virginia amendments rather than relying on a generic IFC checklist.
87 CSR 1 — Fire Code
State Fire Code / Legislative regulation.- Authority
- West Virginia State Fire Commission.
- Classification
- State Fire Code / Legislative regulation.
Primary statewide fire and life-safety framework. The currently active version became effective 1 July 2026. It establishes the State Fire Code and incorporates NFPA fire/life-safety standards subject to West Virginia modifications. It is relevant to assembly occupancies, exits, emergency arrangements, tents, cooking, combustible materials, fire protection, occupant safety and crowd management.
Fire & Life Safety Inspections
Government Resource / Inspection authority.- Authority
- West Virginia Office of the State Fire Marshal.
- Classification
- Government Resource / Inspection authority.
The Fire Safety Inspection Division conducts fire and life-safety inspections in occupancies other than one- and two-family dwellings and provides an electronic inspection-request process. This is an important contact where an event venue, assembly occupancy or temporary event raises State Fire Code compliance issues.
Building Codes And Assembly Occupancies
West Virginia's building-code system is materially different from its fire-code system.
The State Fire Commission promulgates the technical State Building Code, but statute expressly provides that the code has force and effect in counties and municipalities that adopt it. Enforcement is the responsibility of the respective local jurisdiction.
The active 87 CSR 4 version is dated 1 August 2022. The Secretary of State also records a newer rule as “In Progress,” so organizers and design professionals should confirm whether that amendment has become effective before relying on the 2022 version in future projects.
The active framework incorporates ICC standards including the International Building Code. Consequently, where adopted locally, assembly classifications, structural loads, temporary stages, platforms, bleachers, grandstands, accessible design and means of egress may be regulated through the State Building Code.
87 CSR 4 — State Building Code
Building Code / Legislative regulation.- Authority
- West Virginia State Fire Commission.
- Classification
- Building Code / Legislative regulation.
Technical building-code framework affecting assembly occupancies, temporary structures, stages, platforms, seating, structural design, accessibility and means of egress where adopted by the applicable county or municipality. The 1 August 2022 rule remains listed as active, with a replacement in progress.
W. Va. Code §15A-11-5 — State Building Code and Local Adoption
Legislation.- Authority
- West Virginia Legislature / State Fire Commission.
- Classification
- Legislation.
Critical provision establishing that the State Building Code has force and effect in counties and municipalities that adopt it and that enforcement is the responsibility of the local jurisdiction. It also allows more stringent state or local requirements in appropriate circumstances. Event organizers therefore need to determine the building-code adoption status of the specific municipality or county.
State Fire Marshal
The West Virginia Office of the State Fire Marshal has major event relevance. Functions include fire and life-safety inspection, plans review, pyrotechnician regulation, fireworks permits, explosive regulation, electrical licensing and building-code enforcement licensing.
West Virginia Office of the State Fire Marshal
Government Resource / Fire safety authority.- Authority
- West Virginia Department of Homeland Security / State Fire Commission framework.

Emergency Management
West Virginia Emergency Management Division coordinates statewide preparedness, response, recovery and mitigation and operates the State Emergency Operations Center when activated. Direct emergency assistance remains heavily dependent on county and local emergency-management agencies.
For significant festivals, concerts, races and sporting events, liaison with the county emergency manager may therefore be appropriate where severe weather, evacuation, mass casualty, resource coordination or multi-agency planning is foreseeable.
West Virginia Emergency Management Division
Government Resource / Emergency management.- Authority
- West Virginia Department of Homeland Security.
- Classification
- Government Resource / Emergency management.
State coordinating agency for preparedness, mitigation, response and recovery. It supports local emergency managers and first responders and operates the State Emergency Operations Center when activated. West Virginia Local Emergency Management Contact Information
Directory / Government Resource.- Authority
- West Virginia Emergency Management Division.
- Classification
- Directory / Government Resource.
Provides the statewide route to county/local emergency-management contacts. This is particularly useful because emergency arrangements for individual events will frequently need to be coordinated locally rather than through a universal state event-planning process.
Emergency Medical Services
West Virginia regulates EMS agencies and personnel at state level, but this research did not identify a universal statewide event-medical staffing formula based solely on crowd size.
Organizers should distinguish between regulation of EMS providers and the question of how many ambulances, first-aid posts or medical personnel a particular event requires. The latter will commonly be determined through local EMS, health, venue, fire or special-event planning processes based on event risk.
West Virginia Office of Emergency Medical Services
Government Resource / EMS authority.- Authority
- West Virginia Department of Health.
- Classification
- Government Resource / EMS authority.
State EMS authority responsible for the comprehensive EMS system. Relevant to licensed ambulance/EMS agencies, provider standards and medical-resource planning for events.
64 CSR 48 — Emergency Medical Services

- West Virginia Department of Health.
- Classification
- Regulation.
Current statewide EMS rule, effective 1 July 2026. It governs the regulated EMS system and should be checked where event medical coverage will involve licensed EMS agencies, ambulances or state-certified EMS personnel.
Public Health And Sanitation
Public-health regulation is a significant component of West Virginia event planning.
The General Sanitation rule addresses recreational facilities including fairs, festivals and mass gatherings and contains provisions dealing with sewage, toilets, potable water, refuse, premises safety and health-officer inspections.
Health permitting is therefore not simply a food-vendor issue. Outdoor mass gatherings and festival sites can themselves come within the public-health regulatory framework.
64 CSR 18 — General Sanitation
Public-health regulation.- Authority
- West Virginia Department of Health.
- Classification
- Public-health regulation.
Governs sanitation for covered recreational facilities including fairs, festivals and mass gatherings. Particularly important for toilets, water supply, sewage, refuse, premises conditions, permitting and inspection. The mass-gathering-specific provisions make this one of West Virginia's most important event regulations.
Food Safety And Temporary Food Events
Food concessions at festivals and other events are governed through West Virginia food-establishment law and health-department administration.
Mobile vendors have a particularly useful statewide licensing provision: a qualifying in-state mobile food establishment can receive a statewide permit from its home local/county health department. However, the statute expressly requires the vendor to notify the health department having jurisdiction at least 72 hours before operating in that jurisdiction, and that local department may impose conditions necessary to assure compliance with its rules and standards.
Temporary food operations that are not covered by the mobile statewide-permit provision should be checked with the local health department.
64 CSR 17 — Food Establishments
Food-safety regulation.- Authority
- West Virginia Department of Health.
- Classification
- Food-safety regulation.
Main food-establishment regulatory framework relevant to concessions, temporary food operations, mobile food units and food preparation at festivals and public events. The Secretary of State lists the 1 April 2023 version as active and a replacement rule as in progress.
W. Va. Code §16-2-18 — In-State Mobile Food Establishment Statewide Permit
Legislation / Food permit.- Authority
- West Virginia Legislature / Local and County Health Departments.
- Classification
- Legislation / Food permit.
Creates a statewide mobile food-establishment permit issued by the vendor's home local or county health department. Other West Virginia health departments may not impose an additional permit fee, but they may impose appropriate compliance conditions. Vendors must give the health department with jurisdiction at least 72 hours' notice before operating.
Alcohol Licensing
The West Virginia Alcohol Beverage Control Administration (ABCA) regulates alcoholic-beverage licensing.
West Virginia has event-specific fair/festival licensing categories rather than requiring organizers to force every event into a conventional permanent-premises licence.
The ABCA licensing page lists special-event fair/festival licences and private multi-vendor fair/festival categories.
West Virginia ABCA — Licensing
Licensing / Government Resource.- Authority
- West Virginia Alcohol Beverage Control Administration.
- Classification
- Licensing / Government Resource.

Legislation / Special-event alcohol licence.- Authority
- West Virginia Legislature / ABCA.
- Classification
- Legislation / Special-event alcohol licence.
Provides a statutory fair/festival licensing mechanism. The licence is event-specific and subject to ABCA approval and statutory operating requirements. Current law limits this licence to no more than ten consecutive days.
W. Va. Code §60-7-8c — Multi-Vendor Private Fair and Festival Licence
Legislation / Special-event licence.- Authority
- West Virginia Legislature / ABCA.
- Classification
- Legislation / Special-event licence.
Creates the Class S3 multi-vendor private fair and festival licence. The event must be sponsored, endorsed or approved by the governing county or municipality or its designee; the joint application must generally be filed at least 15 days before the event; and the event is limited to no more than 15 consecutive days. The statute also includes food, vendor and age-verification requirements.
Private Security Regulation
Private event-security services are regulated through the West Virginia Secretary of State.
The Secretary of State expressly states that persons or groups performing security-guard functions in West Virginia must be licensed unless a statutory exemption applies.
A distinction must be maintained between licensed private security personnel and sworn police officers. A security-guard licence does not convert private event personnel into law-enforcement officers or confer general police powers.
Private Investigator and Security Guard Licensing
Licensing / Government Resource.- Authority
- West Virginia Secretary of State.
- Classification
- Licensing / Government Resource.
Principal licensing portal for individuals and firms performing private security services. Provides eligibility requirements, forms, exemptions, renewals and licence-search facilities. Organizers contracting commercial event-security providers should verify the licensing status of the provider.

Legislation.- Authority
- West Virginia Legislature / Secretary of State.
- Classification
- Legislation.
Makes the licensed firm responsible for supervision of persons performing security-guard business under the firm's authority, including reasonably necessary education or training. Covered personnel must satisfy statutory eligibility provisions, and the firm must maintain required photographs and fingerprints. This is directly relevant when a contractor deploys teams of event-security guards.
Security Guard Firm Licensing

- West Virginia Secretary of State.
- Classification
- Licence / Government guidance.
Describes licensing of firms employing or allowing others to perform security-guard services. The current process includes a qualifying agent, employee information, required documentation and proof of a surety bond or liability insurance.
Crowd Management
West Virginia does not rely on an adopted International Fire Code crowd-manager provision. Instead, crowd-management requirements must be traced through the State Fire Code's incorporation of NFPA 101 and other NFPA provisions.
Accordingly, assembly-event organizers should determine with the fire AHJ whether the incorporated NFPA crowd-manager provisions apply to their particular occupancy and occupant load.
The important point for professional planning is that crowd-manager obligations should not be assumed from the IFC: West Virginia's adopted fire-code route is different.
87 CSR 1 — State Fire Code and Incorporated NFPA Life Safety Requirements
Fire Code.- Authority
- West Virginia State Fire Commission.
- Classification
- Fire Code.
Primary legal route for assembly crowd-management duties. The current State Fire Code incorporates NFPA standards, including the Life Safety Code framework, subject to West Virginia amendments. Event organizers should obtain the applicable assembly-occupancy and crowd-manager requirements from the current incorporated standard and confirm interpretation with the fire AHJ.
Temporary Structures
Temporary stages, roof structures, FOH structures, viewing platforms, towers, grandstands, bleachers and temporary seating can engage two regulatory layers:
the State Fire Code, applicable as a fire/life-safety framework; and
the State Building Code where adopted locally, with the local building official responsible for enforcement.
A promoter should therefore not assume that an engineer's structural certificate alone constitutes regulatory approval.
87 CSR 4 — State Building Code
Building Code.- Authority
- West Virginia State Fire Commission / adopting county or municipality.
- Classification
- Building Code.
Where locally adopted, provides the building-code framework for structural safety, stages, platforms, temporary seating and other structures. Local building officials should be consulted about permits, calculations, inspections and professional design documentation.
State Fire Marshal — Plans Review Division
Government Resource / Plans review.- Authority
- West Virginia Office of the State Fire Marshal.
- Classification
- Government Resource / Plans review.
Provides State Fire Marshal plans-review services and contacts. Particularly relevant where a project or installation requires state fire/life-safety plan review or where the organizer needs to establish whether State Fire Marshal review is required in addition to local building approval.
Tents And Membrane Structures
No separate West Virginia statewide event-tent webpage establishing a simple universal square-foot permit threshold was identified during this research.
Tents and membrane structures nevertheless remain subject to the adopted State Fire Code and incorporated NFPA requirements. Depending on the jurisdiction and event, the local fire marshal or State Fire Marshal may require inspection or approval, and locally adopted building-code requirements can also apply.
Matters to confirm with the AHJ include exits, occupant load, flame resistance, cooking, heating, generators, extinguishers, smoking, separation distances, emergency lighting and fire-department access.
87 CSR 1 — Fire Code
Fire Code.- Authority
- West Virginia State Fire Commission.
- Classification
- Fire Code.
Primary statewide fire/life-safety framework for tents and temporary membrane structures. The applicable requirements should be determined from the current incorporated NFPA standards and West Virginia amendments rather than assuming International Fire Code tent thresholds.
Pyrotechnics And Fireworks
West Virginia has a clear state-level permitting system for public fireworks displays.
A municipality, county, fair association, amusement park or other organization must obtain a permit from the State Fire Marshal to present a public fireworks display. The statute requires an application, a fee not exceeding $50, proof of financial responsibility and other information required by rule. Written notice to local police and fire authorities is required at least five days before the display.
The display must be operated by a competent operator licensed or certified by the State Fire Marshal and must be safe in the opinion of the fire chief serving the locality.
W. Va. Code §29-3E-6 — Required Permit for Public Fireworks Display
Legislation / Permit.- Authority
- West Virginia Legislature / State Fire Marshal.
- Classification
- Legislation / Permit.
Central statutory requirement for professional public fireworks displays at festivals, fairs, amusement parks and other public events. Establishes the State Fire Marshal permit, financial-responsibility requirement, local police/fire notification and licensed-operator framework.

- West Virginia Office of the State Fire Marshal.
- Classification
- Licensing / Permit applications.
Provides current pyrotechnician licensing and fireworks permitting resources, including the Display Fireworks Permit Application and pyrotechnician licensing processes.
Amusement Rides And Attractions
West Virginia regulates amusement rides and attractions through the Division of Labor.
The state program is directly relevant to carnivals, fairs, festivals, inflatable attractions and other temporary amusement operations. The Division states that every regulated ride or attraction must be inspected before its first use in the state each calendar year.
State statute requires a permit before operation and establishes inspection, incident-reporting, insurance and enforcement requirements.
West Virginia Division of Labor — Amusement Rides & Attractions
Regulatory programme / Government Resource.- Authority
- West Virginia Division of Labor.
- Classification
- Regulatory programme / Government Resource.

Legislation.- Authority
- West Virginia Legislature / Division of Labor.
- Classification
- Legislation.
Comprehensive state statute covering permits, inspections, certificates, new rides, serious-injury reporting, unsafe-operation orders, insurance/bonds, minimum operator age, local regulation and penalties.
Occupational Safety And Health
West Virginia is not an OSHA-approved State Plan state. Federal OSHA has jurisdiction over most private-sector employers in West Virginia. State and local government employees are outside federal OSHA jurisdiction.
West Virginia nevertheless operates a separate WV State OSHA Program through the Division of Labor for covered state agencies under state law. The state programme states that it adopted federal OSHA standards that were in effect on 15 April 1998 for covered state agencies. Other public entities may have an opt-in route.
This distinction is important at events involving private promoters, public authorities, municipal employees and contractors.
Federal OSHA — West Virginia Jurisdiction
Government Resource / Jurisdictional guidance.- Authority
- United States Occupational Safety and Health Administration.
- Classification
- Government Resource / Jurisdictional guidance.
Confirms that West Virginia is not an OSHA-approved State Plan and that federal OSHA covers most private-sector workers. Event-industry applications can include temporary structures, electrical work, rigging, work at height, powered equipment, heat exposure and emergency-action planning.

- Occupational-safety programme.
State occupational-safety programme applicable principally to state agencies under W. Va. Code §21-3A. Useful for publicly operated event sites and events using state employees, while private contractors normally remain under federal OSHA.
Roads, Highways And Traffic Management
The West Virginia Division of Highways controls state highway right-of-way and operates the state's encroachment-permit system.
Any parade, race, festival, filming activity, temporary access arrangement or road closure affecting a state-maintained highway should therefore be raised with WVDOT/Division of Highways rather than relying solely on municipal approval.
Traffic-control arrangements must also satisfy applicable highway standards, and police/traffic-control requirements can be imposed locally.
WVDOT — Encroachment Permits
Permit / Highway authority.- Authority
- West Virginia Department of Transportation / Division of Highways.
- Classification
- Permit / Highway authority.
Main state permitting route for activities affecting state highway right-of-way. Event promoters should use this resource where temporary event activity, access, traffic-control equipment or closure affects a state road.
Parades, Races And Processions
No single statewide permit for every street parade, marathon, demonstration or procession was identified.
In practice, these activities are principally subject to the applicable municipality or county's special-event, parade, police and road-closure procedures. If the route affects a state highway or state right-of-way, WVDOT involvement becomes an additional layer.
Waterborne parades and races have a separate explicit state permit regime addressed in Section 31.
WVDOT Encroachment Permits
Permit / State-highway approval.- Authority
- West Virginia Department of Transportation.
- Classification
- Permit / State-highway approval.
Relevant when a parade, running race, cycling event, procession or street festival occupies or alters a state highway or its right-of-way. Local event approval does not itself authorize use of state highway property.
Fairs And Agricultural Events
Agricultural fairs and festivals can trigger additional animal-health requirements administered by the West Virginia Department of Agriculture.
Current state material covers exhibition livestock, certificates of veterinary inspection, animal identification, disease controls and fair/festival health requirements.
This is in addition to general event requirements for amusement rides, fire safety, food, alcohol and sanitation.
Health Requirements — Imports and Fairs
Government guidance / Animal-health requirements.- Authority
- West Virginia Department of Agriculture, Animal Health Division.
- Classification
- Government guidance / Animal-health requirements.

Current West Virginia fairs, festivals and purebred-consignment-sale animal-health requirements. Relevant where livestock or poultry are exhibited at a public event and therefore important for county fairs, agricultural festivals and livestock shows.
Sports And Spectator Venues
No separate statewide “stadium licence” or general spectator-venue licence was identified.
Stadiums, arenas, motor-racing facilities and college/professional sports venues are instead subject to the normal regulatory stack: State Fire Code, applicable locally adopted building code, occupancy and egress requirements, health provisions, alcohol licensing and local public-safety requirements.
For temporary spectator seating, temporary grandstands or event overlays, structural/building approval can become particularly important.
87 CSR 1 — Fire Code
Fire Code.- Authority
- West Virginia State Fire Commission.
- Classification
- Fire Code.
Statewide fire and life-safety framework for assembly occupancies, including spectator venues and major sporting events. Occupant load, egress, fire protection and crowd-management requirements should be confirmed with the fire AHJ.
Major Entertainment Venues
No distinct West Virginia statewide licence covering every theatre, nightclub, concert venue, arena or convention centre was identified.
The principal state regulatory framework is again cumulative: State Fire Code, locally adopted building code, alcohol licensing where relevant, security regulation, health regulation and local occupancy/special-event controls.
Temporary concert infrastructure should additionally be considered under Sections 13 and 14.
Fire & Life Safety Inspections
Inspection / Government Resource.- Authority
- West Virginia Office of the State Fire Marshal.
- Classification
- Inspection / Government Resource.
Important for theatres, clubs, arenas, concert halls and other assembly occupancies where State Fire Code compliance, exit arrangements, fire protection or life-safety inspection is in question.
Accessibility
Federal ADA obligations apply separately, but West Virginia also has state civil-rights and accessibility provisions.
The West Virginia Human Rights Act prohibits a place of public accommodation from denying accommodations, advantages, facilities, privileges or services because of disability and other protected characteristics.
West Virginia's White Cane Law separately protects equal use of public places and public accommodations by people with disabilities and addresses service animals.
Where the State Building Code is locally adopted, its incorporated accessibility standards add a physical-design layer for applicable construction and alterations.
W. Va. Code §16B-17-9 — Unlawful Discriminatory Practices
Legislation / Civil rights.- Authority
- West Virginia Legislature / Human Rights Commission.
- Classification
- Legislation / Civil rights.
Prohibits discrimination by places of public accommodation, including denial of facilities, privileges and services because of disability. Relevant to event admission, venue services and public-facing event operations.
71 CSR 1 — Rules Regarding Discrimination Against Individuals with Disabilities

W. Va. Code §5-15-4 — Equal Right to Use Public Facilities and Service Animals
Legislation / Accessibility.- Authority
- West Virginia Legislature.
- Classification
- Legislation / Accessibility.
Gives people with disabilities equal rights to public buildings, facilities and places of public accommodation and establishes rights concerning service animals. Relevant to public events, attractions, entertainment premises and spectator facilities.
Severe Weather And Environmental Hazards
West Virginia event planning should place particular emphasis on flash flooding/flooding, severe thunderstorms, lightning, tornadoes, extreme heat, winter weather, snow/ice and wildfire/forest-fire conditions.
No universal state event-weather cancellation threshold was identified. Weather monitoring and decision points should therefore be built into the event emergency plan and coordinated with the applicable local emergency-management and public-safety authorities.
Wildfire controls are more prescriptive. West Virginia has designated forest-fire seasons from 1 March through 31 May and 1 October through 31 December, during which outdoor burning is generally prohibited between 7:00 a.m. and 5:00 p.m., subject to statutory exceptions and additional restrictions.
West Virginia Emergency Management Division
Emergency management / Government Resource.- Authority
- West Virginia Emergency Management Division.
- Classification
- Emergency management / Government Resource.
State coordination point for severe-weather and disaster response. Major outdoor events should integrate county/local emergency-management contacts into weather escalation, evacuation and shelter planning.

Environmental Protection
West Virginia Department of Environmental Protection regulates air, water, waste and other environmental matters that can affect event sites.
Event-specific relevance can include spills, fuel storage, generator operations, wastewater, waste management, open burning and water pollution.
This research did not identify a general statewide event-noise permit. Event noise is therefore likely to be primarily a municipal/county ordinance issue unless another state environmental requirement is triggered.
West Virginia Department of Environmental Protection
Environmental regulator / Government Resource.- Authority
- West Virginia Department of Environmental Protection.
- Classification
- Environmental regulator / Government Resource.
State environmental authority for air, water and land protection. Relevant where festivals or temporary event sites create regulated wastewater, fuel/spill, waste, air-quality or open-burning issues.
WVDEP Emergency Spill Reporting
Incident reporting / Government Resource.- Authority
- West Virginia Department of Environmental Protection.
- Classification
- Incident reporting / Government Resource.
WVDEP publishes an official emergency spill-reporting route. This is relevant to fuel, generator, chemical or other accidental discharges occurring during event setup, operation or dismantling.
Child Protection And Young Persons
For event operations, West Virginia child-labor rules are more immediately relevant than broad child-protection law.
The current Child Labor rule became effective 16 March 2026. Promoters employing minors in concessions, attractions, entertainment, setup or other temporary work should check permitted occupations, hours and hazardous-work restrictions.
Separate alcohol laws restrict youth access to alcohol-related work and sales.
42 CSR 9 — Child Labor
Regulation / Employment law.- Authority
- West Virginia Division of Labor.
- Classification
- Regulation / Employment law.
Current state child-labor rule. Relevant where minors work at fairs, festivals, food concessions, event production or entertainment operations. Event employers must additionally consider federal child-labor law where applicable.
Law Enforcement And Public Safety
West Virginia State Police is the principal statewide police agency and can provide statewide law-enforcement capability alongside county sheriffs and municipal police departments.
Operational event policing will nevertheless depend heavily upon location. Municipal events ordinarily work with municipal police; unincorporated locations can involve sheriff and State Police resources.
West Virginia State Police
State law enforcement / Government Resource.- Authority
- West Virginia State Police.
- Classification
- State law enforcement / Government Resource.
Statewide law-enforcement agency. Relevant to major-event policing, public order, traffic, criminal investigation and multi-agency coordination, particularly outside municipal jurisdictions. WVSP also participates in the FBI Joint Terrorism Task Force.
West Virginia Department of Homeland Security
Government Resource / Public safety.- Authority
- State of West Virginia.
- Classification
- Government Resource / Public safety.
Cabinet department coordinating state public-safety, homeland-security, law-enforcement and emergency-management systems. Its mission includes response to emergencies, disasters and crime.
Counter-Terrorism And Protective Security
The principal West Virginia state-level intelligence/protective-security resource is the West Virginia Fusion Center.
The Fusion Center combines law enforcement, public safety and private-sector participation and supports collection, analysis and dissemination of intelligence relating to criminal activity, terrorism and all-hazards concerns. It also participates in Suspicious Activity Reporting.
For major events, venues and critical infrastructure, this is a useful state connection for protective-security information and suspicious-activity reporting rather than duplicating federal DHS material.
West Virginia Fusion Center
Intelligence / Protective-security Government Resource.- Authority
- West Virginia Department of Homeland Security.
- Classification
- Intelligence / Protective-security Government Resource.
State intelligence-sharing hub supporting law enforcement, public safety and private-sector partners. Relevant to major-event threat information, suspicious activity, risk assessment and protective-security coordination.
State Event Permits
West Virginia does not appear to operate a single state permit covering all public events.
Instead, direct state permits arise where an event uses particular state property or undertakes regulated activity—for example:
State Capitol events;
public fireworks displays;
amusement rides;
events affecting state highways;
marine races and parades;
health-regulated mass gatherings;
alcohol sales; and
activities on DNR-managed property.
A local special-event permit may therefore exist in addition to, rather than instead of, required state approvals.
West Virginia State Capitol — Event Scheduling
State-property event approval.- Authority
- West Virginia General Services Division.
- Classification
- State-property event approval.
Events at the State Capitol or Capitol grounds must be scheduled through General Services. Current instructions direct applicants to an automated event-request process and identify site restrictions including prohibitions on alcohol, fireworks, candles/open flames and other activities.
State Parks And Public Lands
West Virginia Division of Natural Resources administers rules governing public use of state parks, forests and wildlife management areas.
No single statewide commercial-event application covering every DNR property was identified during this research. Event promoters should therefore contact the specific park or DNR property and obtain site-specific authorization in addition to complying with the public-use rule and any other state/local regulatory requirements.
58 CSR 31 — Rules Governing Public Use of West Virginia State Parks, Forests and Wildlife Management Areas
Regulation / Public-land rules.- Authority
- West Virginia Division of Natural Resources.
- Classification
- Regulation / Public-land rules.
State regulatory framework governing use of DNR-managed parks, forests and wildlife management areas. Relevant to organized events, activities, restricted conduct and site management on state lands. The Secretary of State records the 1 June 2006 version as active.
Water Events
West Virginia has a particularly clear state permit provision for organized water events.
A person in charge of a proposed regatta, motorboat or other boat race, marine parade, tournament or exhibition on state waters must generally file an application with the DNR Director at least 15 days before the event and may not conduct the event without written authorization.
The statute also provides that a separate state permit under this section is not required where an applicable permit has already been obtained from an authorized federal agency, although applicable federal requirements still apply.
W. Va. Code §20-7-20 — Regattas, Races and Exhibitions
Legislation / Event permit.- Authority
- West Virginia Legislature / Division of Natural Resources.
- Classification
- Legislation / Event permit.
Direct state permit requirement for regattas, boat races, marine parades, tournaments and exhibitions on West Virginia waters. Application is required at least 15 days in advance unless the statutory federal-permit exception applies.
Aviation And Drone Considerations
Federal FAA requirements remain the principal aviation layer and are dealt with separately at federal level.
West Virginia nevertheless has state criminal provisions governing unmanned aircraft. State law prohibits certain intentional privacy invasions and harassment and prohibits operation with willful or wanton disregard for the safety of persons or property. It also addresses interference with official public-safety duties and certain operations involving targeted facilities.
No blanket statewide prohibition on drones at every public event or every state park was identified in this research. Property-specific restrictions and the landowner's permission should therefore be checked separately.
W. Va. Code §61-16-2 — Prohibited Use of an Unmanned Aerial Vehicle
Legislation / Criminal law.- Authority
- West Virginia Legislature.
- Classification
- Legislation / Criminal law.
State-specific drone restrictions relevant to event aerial filming and drone operations, including privacy, harassment, safety and interference with official activity. These provisions operate alongside federal FAA rules rather than replacing them.
Incident Reporting And Accident Investigation
The clearest event-specific state accident-reporting regime identified is for amusement rides and attractions.
An owner or operator must notify the Division of Labor within 24 hours after a fatality or an accident caused by operation of a ride or attraction that results in serious physical injury requiring medical treatment or causes loss of consciousness. The Division investigates such incidents and safety-related complaints.
Other incidents can trigger separate reporting regimes—for example environmental spills, workplace incidents or fire investigations—depending on circumstances.
W. Va. Code §21-10-9 — Amusement Ride Serious Injury and Fatality Reporting
Legislation / Mandatory incident reporting.- Authority
- West Virginia Legislature / Division of Labor.
- Classification
- Legislation / Mandatory incident reporting.
Requires amusement ride/attraction operators to notify the Division of Labor within 24 hours of qualifying serious injuries, loss-of-consciousness incidents or fatalities. Operators must also retain event-site accident records as prescribed.
WVDEP Emergency Spill Reporting
Incident-reporting Government Resource.- Authority
- West Virginia Department of Environmental Protection.
- Classification
- Incident-reporting Government Resource.
Relevant where an event experiences an accidental fuel, chemical or other environmental discharge requiring state notification.
Insurance And Liability
No universal state law requiring every festival or public gathering to maintain a single prescribed amount of event liability insurance was identified.
However, specific regulated event activities do carry mandatory financial-responsibility requirements.
For amusement rides and attractions, West Virginia law requires approved insurance of at least $300,000 per person and $1 million aggregate for each amusement ride or attraction location, or an approved bond or other security in the same framework. Evidence must accompany the permit application.
Public fireworks-display permits also require proof of financial responsibility in the form and amount required by the State Fire Marshal, and the fireworks statute contains an additional operator-bond provision.
Private security firms are separately required to provide prescribed bond or liability-insurance documentation through the Secretary of State licensing process.
W. Va. Code §21-10-12 — Amusement Ride Insurance or Bond
Legislation / Mandatory insurance.- Authority
- West Virginia Legislature / Division of Labor.
- Classification
- Legislation / Mandatory insurance.
Prohibits operation of a regulated amusement ride or attraction without the prescribed insurance, bond or approved security. The statutory insurance minimum is $300,000 per person and $1 million aggregate for each ride or attraction location.
W. Va. Code §29-3E-6 — Fireworks Financial Responsibility
Legislation / Financial-responsibility requirement.- Authority
- West Virginia Legislature / State Fire Marshal.
- Classification
- Legislation / Financial-responsibility requirement.
Requires public fireworks-display applicants to furnish proof of financial responsibility in an amount, character and form determined necessary by the State Fire Marshal to protect the public.
County And Municipal Authority
The local regulatory layer is essential in West Virginia.
A promoter should not interpret compliance with state health, fire, alcohol, amusement-ride or other requirements as automatic authorization to hold an event.
Local authorities may regulate or administer:
special-event permits; use of public property; street closures; parades; local police deployment; fire inspections; building permits; temporary stages and structures; tents; occupancy; food-health coordination; sanitation; local emergency medical arrangements; parking and traffic; noise; zoning; signage; alcohol-area endorsement; and other operational matters.
Building-code jurisdiction is particularly important. State statute provides that the State Building Code becomes effective in counties and municipalities that adopt it, with enforcement undertaken locally.
W. Va. Code §7-1-3n — County Building-Code Authority
Legislation / Local-government authority.- Authority
- West Virginia Legislature / County Commissions.
- Classification
- Legislation / Local-government authority.
Authorizes county building-code adoption and explains interaction with the State Building Code and incorporated municipalities. Relevant to events using stages, temporary structures, bleachers, grandstands or other installations requiring local building review.
W. Va. Code §8-12-13 — Municipal Building Regulation
Legislation / Local-government authority.- Authority
- West Virginia Legislature / Municipalities.
- Classification
- Legislation / Local-government authority.
Gives municipalities authority over building regulation and permits adoption of the State Building Code. This confirms that municipal building officials can be a central AHJ for event structures and venue alterations.
Authority Having Jurisdiction — West Virginia Event Application
For practical event planning in West Virginia, the Authority Having Jurisdiction (AHJ) should be identified at the earliest planning stage.
Depending on the event, the AHJ or approving bodies can include the local fire marshal or State Fire Marshal; municipal or county building official; local/county health department; municipal police, county sheriff or West Virginia State Police; county emergency-management agency; local EMS authority; ABCA; Division of Labor; WVDOT; DNR; General Services where state property is involved; and the owner or manager of the venue.
This is particularly important because West Virginia combines:
a statewide Fire Code; a locally adopted/enforced State Building Code; state public-health mass-gathering rules; and numerous activity-specific state permits.
Consequently, an organizer can be compliant with one regulatory layer while still lacking permission under another.
West Virginia — Key Event-Safety Triggers
For rapid professional reference, the most important West Virginia-specific triggers identified are:
Mass gathering: 250 or more persons under 64 CSR 18, subject to the permanent-large-assembly exclusion.
Mass-gathering sanitation: specific state provisions for usable site area, toilets, parking, potable water, waste and sanitation.
State Fire Code: 87 CSR 1 is statewide; current version effective 1 July 2026.
Building Code: state technical code, but force and local enforcement depend on county/municipal adoption.
Crowd management: derive requirements through the State Fire Code's incorporated NFPA assembly/life-safety framework rather than assuming IFC provisions.
Food: state food rule plus local-health administration; qualifying in-state mobile vendors use a statewide permit but must give the destination health department at least 72 hours' notice.
Alcohol: dedicated fair/festival and multi-vendor event licence mechanisms exist.
Private security: commercial security guard functions are state licensed through the Secretary of State unless an exemption applies.
Fireworks: public displays require a State Fire Marshal permit, appropriate operator and financial responsibility.
Amusement rides: state permits/inspections, insurance and serious-incident reporting apply.
Water events: regattas, boat races and marine parades normally require DNR application at least 15 days in advance.
Capitol events: require General Services approval.
State highways: WVDOT approval is an additional layer where event activity affects state highway property.
Outdoor burning/wildfire: seasonal statewide burning restrictions are particularly relevant to outdoor events.
Local approval: remains essential for special events, roads, fire inspection, structures, parades, police, noise and other operational matters.
