State Government and Legislative Framework
Wisconsin Legislature — Statutes and Administrative Code
Legislation and Administrative Code Portal.- Authority
- Wisconsin Legislature / Legislative Reference Bureau.
- Classification
- Legislation and Administrative Code Portal.
The official legislative-document system is the principal source for Wisconsin Statutes and the Wisconsin Administrative Code. Event professionals may need it for Chapters 101, 125, 167, 256 and 323 and administrative provisions including SPS 307, SPS 314, SPS 332, SPS 334 and SPS 361–366. DSPS expressly directs users to the Legislature's system for the current versions of its statutes and administrative rules. (DSPS)
DSPS Administrative Rules and Statutes
Government Resource / Regulatory Directory.- Authority
- Wisconsin Department of Safety and Professional Services.
- Classification
- Government Resource / Regulatory Directory.
Central DSPS directory of current building, fire, electrical, amusement-ride, explosives, public-sector occupational-safety and sanitation rules. It directly indexes SPS 307, SPS 314, SPS 316, SPS 332, SPS 334, SPS 361–366, SPS 377 and SPS 391. This is one of the most useful starting points for an event-safety compliance review. (DSPS)
Wisconsin Statutes Chapter 101 — Regulation of Industry, Buildings and Safety
Legislation.- Authority
- Wisconsin Legislature.
- Classification
- Legislation.
Principal statutory framework supporting DSPS regulation of public buildings, places of employment, safety and commercial-building regulation. It is relevant to assembly spaces, event barns, temporary changes of use, plan review and inspection authority. DSPS identifies Chapter 101 among its principal governing statutes. (DSPS)
Mass Gatherings and Public Assemblies
Large assemblies are controlled through the applicable fire and building codes, occupant-load and egress requirements, health/food controls, alcohol licensing, traffic/highway approvals, state-property permits and municipal or county special-event systems. The absence of a general state mass-gathering licence therefore does not remove the need for event-specific approvals.
For a festival or concert, the principal questions are normally: site jurisdiction; assembly/building status; fire-code inspection; occupant capacity; temporary structures/tents; food service; alcohol; EMS arrangements required by the local permit/AHJ; traffic closures; private security licensing; and property-specific permission.
Fire and Life Safety
DSPS Fire Prevention / Safety and Health
Government Resource / Fire-Safety Regulatory Resource.- Authority
- Wisconsin Department of Safety and Professional Services, Division of Industry Services.
- Classification
- Government Resource / Fire-Safety Regulatory Resource.
DSPS supports Wisconsin fire-prevention inspection and administers relevant fire-prevention requirements. Its materials cover SPS 314, inspection practice, fire department access, exiting, assembly hazards, tents, seasonal hazards and incident reporting. It is the key statewide regulatory source for event fire and life safety rather than the DOJ State Fire Marshal. (DSPS)
Wisconsin Administrative Code SPS 314 — Fire Prevention
Regulation / Fire Code.- Authority
- Wisconsin Department of Safety and Professional Services / Wisconsin Legislature.
- Classification
- Regulation / Fire Code.
SPS 314 is Wisconsin's principal state fire-prevention rule and is particularly important to public buildings and places of employment, including many assembly/event settings. DSPS identifies SPS 314 as the current fire-prevention chapter. Event planners should use the current text together with the local fire AHJ rather than relying only on generic IFC guidance. (DSPS)
SPS 361 Wisconsin Commercial Building Code Insert — 2021 IBC/IFC Relationship
Code Amendment / Official Code Guidance.- Authority
- Wisconsin Department of Safety and Professional Services.
- Classification
- Code Amendment / Official Code Guidance.
Wisconsin adopted the 2021 ICC commercial-code family effective September 1, 2025. SPS 361.03 specifies which parts of the 2021 International Fire Code apply within the commercial-building-code framework. It expressly includes, among other matters, selected IFC chapters on fire-service features and Chapter 10 egress provisions; occupant loads under IFC 1005.6 are to be established by the designer and approved by the code official. This is important because Wisconsin has not simply adopted the entire current IFC without qualification. (DSPS) Official source https://dsps.wi.gov/Documents/Programs/CommercialBuildings/SPS361Insert.pdf ↗ For events, fire-life-safety review can therefore involve both Wisconsin's SPS 314 fire-prevention framework and the construction/use provisions embedded within the commercial-building code. Local fire and building officials remain critical AHJs.
Building Codes and Assembly Occupancies
DSPS Commercial Buildings Program
Building-Code Regulatory Resource.- Authority
- Wisconsin Department of Safety and Professional Services, Division of Industry Services.
- Classification
- Building-Code Regulatory Resource.
Wisconsin's commercial-building program reviews public buildings and places of employment and coordinates with certified local municipalities. DSPS states that the Wisconsin Commercial Building Code adopted the 2021 ICC codes on September 1, 2025, and that plans submitted on or after November 1, 2025 must comply with the updated code. DSPS specifically lists commercial-building, fire-alarm, fire-suppression and bleacher plan reviews. Structural calculations may be required, and local permits can apply even where state review is involved. (dsps.wi.gov)
Wisconsin Administrative Code SPS 361 — Commercial Building Administration and Enforcement
Regulation / Building Code.- Authority
- Wisconsin Department of Safety and Professional Services / Wisconsin Legislature.
- Classification
- Regulation / Building Code.
Establishes administration and enforcement provisions for Wisconsin's commercial-building code. It is relevant when determining code applicability, plan review, code-official authority and how the adopted IBC/IFC provisions interact with Wisconsin amendments. (DSPS)
Wisconsin Administrative Code SPS 362 — Buildings and Structures
Regulation / Building Code.- Authority
- Wisconsin Department of Safety and Professional Services / Wisconsin Legislature.
- Classification
- Regulation / Building Code.
Contains Wisconsin's substantive amendments and provisions governing commercial buildings and structures. Assembly occupancies, occupant loads, egress, structural features, stages, seating and related event-facility questions should be checked against SPS 362 and the incorporated 2021 IBC provisions. (DSPS)
SPS 366 — Existing Buildings and Temporary Use
Regulation / Code Amendment.- Authority
- Wisconsin Department of Safety and Professional Services.
- Classification
- Regulation / Code Amendment.
Especially useful where an existing building is temporarily converted to event use. Wisconsin's current amendment allows a municipal fire or building code official to permit an existing building or part of it to be used temporarily in a manner different from the approved use. The official sets the duration according to hazards; the normal maximum is 180 days, with extensions for demonstrated cause, and the official may impose additional safety measures or terminate the temporary approval. A local temporary-use permit cannot override a state corrective building order. Official source https://dsps.wi.gov/Documents/Programs/CommercialBuildings/SPS366Insert.pdf ↗ This temporary-use provision is highly relevant to warehouses, barns, halls and other spaces proposed for occasional public events.
State Fire Marshal
Wisconsin DOJ State Fire Marshal
State Fire Marshal / Law-Enforcement Resource.- Authority
- Wisconsin Department of Justice, Division of Criminal Investigation.
- Classification
- State Fire Marshal / Law-Enforcement Resource.
Wisconsin's State Fire Marshal function is located within DOJ and focuses on investigation of the origin and cause of fires and explosions and related criminal-investigative work. It should not be presented as Wisconsin's general building-code or routine event-fire-inspection office; those functions are principally associated with DSPS and local fire/code officials. (Wisconsin Department of Justice) Official source https://www.wisdoj.gov/Pages/CriminalJusticeServices/state-fire-marshal.aspx ↗ For a normal festival, concert or sports event, the local fire marshal/fire department and applicable building official are more likely to be the operational AHJs for exits, tents, temporary use, cooking, fire lanes, fire extinguishers and assembly conditions.
Emergency Management
Wisconsin Emergency Management
Emergency-Management Agency / Government Resource.- Authority
- Wisconsin Department of Military Affairs, Wisconsin Emergency Management.
- Classification
- Emergency-Management Agency / Government Resource.

DHS is the principal statewide public-health authority and is relevant to communicable-disease response, public-health emergencies and EMS. Local and county health departments remain important operational authorities for events.
Wisconsin Administrative Code SPS 391 — Sanitation
Regulation / Sanitation Code.- Authority
- Wisconsin Department of Safety and Professional Services / Wisconsin Legislature.
- Classification
- Regulation / Sanitation Code.
SPS 391 is part of Wisconsin's state sanitation framework. It should be checked where event premises, sanitary facilities or regulated public facilities bring its provisions into scope. It should not be used as a substitute for any separate local health-department requirements. (DSPS) Official source https://docs.legis.wisconsin.gov/code/admin_code/sps/safety_and_buildings_and_environment/388/391 ↗ Temporary toilets, potable water, handwashing, waste collection and site sanitation can additionally be conditions of municipal permits, food-service licensing or landowner approvals.
Food Safety and Temporary Food Events
Mobile and Transient Retail Food Establishments
Licensing / Food-Safety Guidance.- Authority
- Wisconsin Department of Agriculture, Trade and Consumer Protection.
- Classification
- Licensing / Food-Safety Guidance.
DATCP defines and regulates mobile and transient retail food establishments. A transient retail food establishment includes a food operation at a fixed location in conjunction with a special event for no more than 14 consecutive days, or certain occasional sales promotions. Licensing may be handled by DATCP or an agent local health department, and local jurisdictions may perform inspections and charge fees. This is directly relevant to festivals, fairs, markets and temporary food concessions. (DATCP)

Alcohol Licensing
Wisconsin DOR Alcohol Beverage Regulation
Alcohol Regulatory Portal.- Authority
- Wisconsin Department of Revenue.
- Classification
- Alcohol Regulatory Portal.
Central state resource for Wisconsin alcohol laws, licences, permits and retailer requirements. Retail alcohol licensing is heavily municipal: cities, villages and towns issue many retail licences under Chapter 125, while DOR administers the statewide regulatory framework. (Wisconsin Department of Revenue)
Wisconsin Statutes Chapter 125 — Alcohol Beverages
Legislation.- Authority
- Wisconsin Legislature.
- Classification
- Legislation.
Principal statutory framework for alcohol sales and service, including retail licensing, temporary Class “B”/“Class B” licences, operators, underage-person controls and licensed-premises rules. Event organisers selling or supplying alcohol should determine the correct licensing mechanism before assuming an ordinary venue licence covers the event.
Form AB-220 — Temporary Alcohol Beverage License Application
Temporary Licence Application / Official Guidance.- Authority
- Wisconsin Department of Revenue.
- Classification
- Temporary Licence Application / Official Guidance.
The form explains that cities, villages and towns issue alcohol beverage licences. Eligible nonprofit organisations may obtain temporary licences for qualifying limited-duration activities including fundraisers, public picnics, fair booths and festivals. Temporary licences cover beer and/or wine as applicable but do not authorise distilled-spirit sales. The licensed premises must be approved by the municipal governing body. (Wisconsin Department of Revenue)
Publication 309 — Retail Alcohol Beverage Licensing Guide for Municipalities
Official Licensing Guidance.- Authority
- Wisconsin Department of Revenue.
- Classification
- Official Licensing Guidance.
The March 2026 guide provides detailed current guidance on municipal alcohol licensing. It covers temporary beer and wine licences, eligible organisations, supervision by authorised operators, beer/wine walks and temporary operator licences. Temporary operator licences may be valid for up to 14 days and are limited as specified by state law. (Wisconsin Department of Revenue)
Event Venue Alcohol Beverage Law Implementation
Regulatory Guidance.- Authority
- Wisconsin Department of Revenue.
- Classification
- Regulatory Guidance.
A particularly important recent Wisconsin development. DOR explains implementation of legislation affecting public rental/event venues from January 1, 2026. Organisers and venue operators should confirm whether the venue itself requires an appropriate alcohol licence or permit and whether event-specific arrangements satisfy the new regime. (Wisconsin Department of Revenue)
Private Security Regulation
DSPS Private Security Person
Occupational Licensing.- Authority
- Wisconsin Department of Safety and Professional Services.
- Classification
- Occupational Licensing.
A person acting as a regulated private security person for a licensed private detective/security agency generally requires the applicable Wisconsin permit. A separate firearm permit is required to carry a firearm while performing regulated duties. This is directly relevant to contracted festival, concert, nightlife and venue security. (DSPS)
DSPS Private Detective / Security Agency
Business Licensing.- Authority
- Wisconsin Department of Safety and Professional Services.
- Classification
- Business Licensing.
Regulates private detective/security agencies. Wisconsin requires an agency credential and statutory financial-security/liability provisions; the state page identifies the applicable licensing framework. An event engaging a commercial security company should verify both the agency and individual personnel credentials where required. (DSPS)
Wisconsin Statutes § 440.26 — Private Detective and Security Regulation
Legislation.- Authority
- Wisconsin Legislature.
- Classification
- Legislation.
Governs the statutory licensing framework for private detective and private security activity, including agency requirements. It is useful when determining whether a contracted event-security arrangement falls within regulated private-security activity rather than ordinary in-house employment. Official source https://docs.legis.wisconsin.gov/statutes/statutes/440/26 ↗ Security personnel are not law-enforcement officers merely because they are licensed private security. Police powers, arrests, public-order command and traffic enforcement remain distinct governmental functions. Event plans should clearly define the respective roles of private security, local police and sheriff's personnel.
Crowd Management
Wisconsin has an important crowd-management provision within its adopted fire-code framework. DSPS training material explaining Wisconsin's NFPA 1 provisions states that assembly occupancies require at least one trained crowd manager or crowd-manager supervisor and, where occupant load exceeds 250, additional trained crowd managers at a ratio of one per 250 occupants, subject to stated exceptions and potential AHJ-approved reductions. The material also requires approved crowd-management training. (DSPS)
Because the precise applicability depends on occupancy classification, use and AHJ interpretation, this requirement should be checked against the current SPS 314/NFPA 1 text and the local fire AHJ, rather than automatically applying a 1:250 ratio to every outdoor event.
DSPS — Schools and the Fire Code / Crowd Manager Training Material
Official Fire-Code Training Guidance.- Authority
- Wisconsin Department of Safety and Professional Services.
- Classification
- Official Fire-Code Training Guidance.
Provides Wisconsin-specific explanation of assembly-occupancy crowd managers, occupant-load posting, egress and other fire-safety requirements. Although the training presentation uses school examples, its crowd-manager slides reproduce assembly-occupancy requirements and are operationally useful for understanding Wisconsin enforcement expectations. (DSPS)
Temporary Structures
DSPS expressly offers bleacher plan review, and commercial-building submissions can require stamped/sealed structural calculations. In delegated municipalities, local inspectors undertake applicable inspections and local permits may also be required. (dsps.wi.gov)
Temporary changes in use of an existing building can be authorised by a municipal fire/building official under the SPS 366 mechanism described above. For engineered temporary event structures, organisers should obtain an early ruling from the building official on whether state or delegated-municipality plan review and professional engineering are required.
Tents and Membrane Structures
Tents and membrane structures are primarily a fire-code/AHJ matter in Wisconsin rather than a single statewide special-event-office process. SPS 314, its incorporated standards and local fire enforcement should be checked for permit requirements, flame resistance, exits, cooking/heating, extinguishers, separation, ignition sources and occupant capacity.
DSPS's fire-prevention training catalogue specifically includes material on tents and related temporary occupancies, confirming that they fall within the state's fire-prevention enforcement framework. (DSPS)
Do not assume a generic national IFC tent-size threshold automatically governs a Wisconsin event without checking SPS 314 and the municipal fire AHJ.
Pyrotechnics and Fireworks
DSPS Explosives Program
Licensing / Regulatory Resource.- Authority
- Wisconsin Department of Safety and Professional Services.
- Classification
- Licensing / Regulatory Resource.
DSPS regulates explosives and credentials blasters and conducts associated inspections. This is relevant to event operations involving explosive materials and to determining whether a proposed fireworks/pyrotechnic activity enters the state's explosives-regulation regime.
Wisconsin Administrative Code SPS 307 — Explosives and Fireworks
Regulation.- Authority
- Wisconsin Department of Safety and Professional Services / Wisconsin Legislature.
- Classification
- Regulation.
State administrative rule governing explosives and fireworks. Event operators using professional fireworks or pyrotechnic materials should review SPS 307 together with Wis. Stat. §167.10, fire-code requirements and the local permit/AHJ process. DSPS lists SPS 307 as a current rule. (DSPS)
Wisconsin Statutes § 167.10 — Fireworks
Legislation.- Authority
- Wisconsin Legislature.
- Classification
- Legislation.
Core Wisconsin fireworks law. It establishes the statutory permit framework and interacts with municipal authority. For public displays, organisers should identify the authorised local issuing authority and separately obtain any required fire-department/site approvals. Local ordinances can be more restrictive, so possession of a permit should not be treated as complete event approval. Official source https://docs.legis.wisconsin.gov/statutes/statutes/167/10 ↗ Proximate-audience pyrotechnics, indoor effects and flame effects need particularly careful AHJ review because ordinary consumer-fireworks rules alone are not an adequate compliance basis.
Amusement Rides and Attractions
DSPS Amusement Rides Program
Regulatory / Inspection Programme.- Authority
- Wisconsin Department of Safety and Professional Services.
- Classification
- Regulatory / Inspection Programme.
DSPS establishes standards for the design, construction, installation, operation and inspection of amusement rides. This is directly applicable to fairs, carnivals, festivals and events incorporating regulated rides or attractions. (DSPS)
Wisconsin Administrative Code SPS 334 — Amusement Rides

DSPS Amusement Ride Registration and Insurance Information
Official Regulatory Guidance.- Authority
- Wisconsin Department of Safety and Professional Services.
- Classification
- Official Regulatory Guidance.
DSPS states that amusement rides must be registered annually before opening to the public. Its guidance identifies minimum liability coverage under SPS 334.035 of $1,000,000 per occurrence for Class 1 and Class 2 rides and $500,000 for non-mechanical and coin-operated rides. This is an important event-specific statutory/code insurance requirement.
DSPS Amusement Ride Accident Report
Mandatory Incident Reporting / Government Form.- Authority
- Wisconsin Department of Safety and Professional Services.
- Classification
- Mandatory Incident Reporting / Government Form.
Wisconsin's ride programme requires specified amusement-ride accidents and injuries to be reported. Event organisers and ride operators should ensure incident escalation procedures identify the DSPS reporting obligation as well as emergency-service notification and internal reporting. Official source https://dsps.wi.gov/Documents/Programs/AmusementRides/SBD211.pdf ↗ Inflatables and non-traditional attractions should not automatically be assumed exempt: DSPS guidance should be checked against the definition of an amusement ride and the particular device.
Occupational Safety and Health
Wisconsin does not operate a full OSHA-approved State Plan covering private-sector employment. Private-sector employers are generally subject to federal OSHA. Wisconsin separately administers safety and health requirements for public-sector employees through state mechanisms. (Wisconsin Workforce Development)
For event production this distinction matters: concert promoters, production contractors, staging companies, caterers and private security employers are generally within federal OSHA jurisdiction, while municipal/public employees can fall within Wisconsin's public-sector regime.
DWD — OSHA's Safety and Health Role in Wisconsin
Government Guidance / Occupational Safety.- Authority
- Wisconsin Department of Workforce Development.
- Classification
- Government Guidance / Occupational Safety.
Explains the division between federal OSHA and Wisconsin state public-sector occupational-safety arrangements. Event-industry employers should use this page to determine the correct enforcement framework. (Wisconsin Workforce Development)
Wisconsin Administrative Code SPS 332 — Public Employee Safety and Health
Regulation / Occupational Safety.- Authority
- Wisconsin Department of Safety and Professional Services / Wisconsin Legislature.
- Classification
- Regulation / Occupational Safety.
State occupational-safety rule relevant to public-sector employees. This can matter where municipal employees, public works staff, public venue employees or other government workers support an event. (DSPS) Official source https://docs.legis.wisconsin.gov/code/admin_code/sps/safety_and_buildings_and_environment/326_360/332 ↗ Event employers should separately address fall protection/work at height, electrical hazards, temporary power, rigging, heat/cold, lifting, vehicle movements, emergency action planning and severe-weather exposure under the rules applicable to their workforce.
Roads, Highways and Traffic Management
WisDOT State Highway Detour Permits
Permit / Highway Use.- Authority
- Wisconsin Department of Transportation.
- Classification
- Permit / Highway Use.
A municipality seeking to detour a state trunk highway for a special event such as a parade must obtain the applicable state-highway detour permit. This is a key state layer for street events whose closure affects a state highway rather than only a municipal street. (Wisconsin Department of Transportation)
Wisconsin Manual on Uniform Traffic Control Devices
Traffic-Control Standard.- Authority
- Wisconsin Department of Transportation.
- Classification
- Traffic-Control Standard.
Wisconsin's traffic-control manual provides the state framework for signs, devices and temporary traffic control. It should be incorporated into traffic-management planning for road closures, races, parades, pedestrian diversions and temporary vehicle routes where applicable. (Wisconsin Department of Transportation) Official source https://wisconsindot.gov/Pages/doing-bus/local-gov/traffic-ops/manuals-and-standards/wmutcd/wmutcd.aspx ↗ Local street closure authority normally remains municipal or county-based unless the state highway system is affected.
Parades, Races and Processions
Traffic management, law-enforcement staffing, barricades, pedestrian control, emergency-access routes and reopening procedures should therefore be established with the road authority and police/sheriff AHJ. The State Highway Detour Permit and WMUTCD resources in Section 18 are the principal statewide references.
Fairs and Agricultural Events
DATCP County and District Fairs
Government Resource / Fair Regulation.- Authority
- Wisconsin Department of Agriculture, Trade and Consumer Protection.
- Classification
- Government Resource / Fair Regulation.
DATCP has a specific regulatory and administrative role in Wisconsin county and district fairs and provides access to the applicable fair programme and ATCP 160 framework. Fairs also commonly intersect with amusement rides, temporary food, alcohol, animal health and local fire/event permitting.
Animal Health Rules for Fairs, Shows and Other Special Events
Regulation / Official Guidance.- Authority
- Wisconsin Department of Agriculture, Trade and Consumer Protection.
- Classification
- Regulation / Official Guidance.
Establishes Wisconsin animal-health requirements for fairs, livestock shows and other special events involving animals. Particularly relevant to agricultural fairs where animal movement, exhibition or disease-control requirements sit alongside crowd-safety arrangements. (DATCP)
Sports and Spectator Venues
Particularly relevant state controls include occupant loads, means of egress, fire protection, emergency lighting, bleachers/grandstands and structural review. DSPS expressly provides bleacher plan review, and the current commercial-building programme should therefore be treated as a central reference for stadiums, arenas, college venues and temporary spectator seating. (dsps.wi.gov)
Local fire, building, police and EMS authorities remain significant AHJs for event-day operations.
Major Entertainment Venues
Concert halls, theatres, arenas, nightclubs and convention facilities are generally regulated as commercial/public buildings and assembly occupancies rather than under a separate Wisconsin concert-venue statute.
Operationally significant matters include approved occupancy, egress, exit obstruction, fire alarms/suppression, crowd managers where applicable, alcohol licensing, temporary changes in use, security and local occupancy/fire inspections.
A venue's existing certificate or building approval should not be assumed to authorise a materially different temporary use, layout, stage installation or increased occupant load.
Accessibility
Wisconsin's current commercial-building framework incorporates the 2021 IBC family with Wisconsin amendments, including accessibility-related construction requirements. Federal ADA obligations continue to apply independently.
For event planning, accessibility review should include accessible routes, entrances, toilet facilities, parking, changes in level, seating/viewing areas and the effect of temporary barriers, cables, tents or event infrastructure. DSPS's Commercial Buildings page includes accessibility materials and code resources. (dsps.wi.gov)
Temporary events should not assume that accessibility obligations disappear because structures or layouts are short-term.
Severe Weather and Environmental Hazards
Wisconsin event planning should give particular attention to severe thunderstorms and lightning, tornadoes, flooding, extreme heat, winter cold/snow/ice and wildfire-smoke/air-quality events. Tropical-cyclone planning is not ordinarily the dominant Wisconsin risk and should not displace the hazards actually experienced in the state.
ReadyWisconsin
Public Emergency-Preparedness Guidance.- Authority
- Wisconsin Emergency Management.
- Classification
- Public Emergency-Preparedness Guidance.
Wisconsin's official preparedness portal provides state-specific hazard information and public-warning guidance. It is useful when constructing event severe-weather triggers, shelter plans and public communications.
ReadyWisconsin — Tornadoes
Severe-Weather Guidance.- Authority
- Wisconsin Emergency Management.
- Classification
- Severe-Weather Guidance.
Wisconsin-specific tornado-preparedness information. Tornado and severe-thunderstorm procedures should be incorporated into outdoor-event emergency plans, especially where crowds cannot rapidly reach substantial shelter.
Wisconsin DNR — Wildfire Smoke
Air-Quality / Public-Health Guidance.- Authority
- Wisconsin Department of Natural Resources.
- Classification
- Air-Quality / Public-Health Guidance.
DNR monitors fine-particle pollution and provides Wisconsin wildfire-smoke guidance. Its event-relevant advice expressly includes considering cancellation of outdoor events or moving them indoors, especially for children, during hazardous smoke conditions. This makes air-quality monitoring a credible event go/no-go consideration. (Wisconsin DNR)
Environmental Protection
Environmental permissions are activity-specific rather than embodied in a general Wisconsin event-environment permit. Noise is commonly a local ordinance matter, while state DNR jurisdiction can arise from waterway/wetland impacts, stormwater, wastewater, air pollution, fuel releases and other regulated environmental activities.
Wisconsin DNR Water Permit Applications
Environmental Permit Portal.- Authority
- Wisconsin Department of Natural Resources.
- Classification
- Environmental Permit Portal.
Central permit system for regulated water and waterway activities, including stormwater, wastewater and various waterway/wetland activities. Relevant where festival infrastructure, waterfront works, crossings, temporary installations or site preparation affect regulated waters or wetlands. (Wisconsin DNR) Official source https://dnr.wisconsin.gov/permits/water ↗ Generators, temporary fuel tanks and event servicing should also be assessed for spill prevention, fire-code separation and any applicable DNR environmental requirements.
Child Protection and Young Persons

(Wisconsin Workforce Development) Official source https://www.dwd.wisconsin.gov/er/laborstandards/workpermit/minoremployment.htm ↗ Alcohol-serving and licensed-premises arrangements must separately comply with Chapter 125's underage-person provisions.
Law Enforcement and Public Safety
Wisconsin Department of Justice
State Law-Enforcement / Public-Safety Resource.- Authority
- Wisconsin Department of Justice.
- Classification
- State Law-Enforcement / Public-Safety Resource.
DOJ's Division of Criminal Investigation provides statewide investigative capability, while DOJ also hosts Wisconsin intelligence/fusion-centre functions. For ordinary events, primary policing will usually be municipal police or the county sheriff, but state resources can support major incidents and interagency operations. (Wisconsin Department of Justice)
Wisconsin State Patrol Tactical Teams
State Law-Enforcement Resource.- Authority
- Wisconsin Department of Transportation, Division of State Patrol.
- Classification
- State Law-Enforcement Resource.
State Patrol specialist capabilities include crowd-management/crowd-control functions and support for special-event security. This is relevant to major planned events requiring state assistance, though local policing remains the normal first layer.
Counter-Terrorism and Protective Security
Wisconsin's principal state-level protective-security structure includes the Wisconsin Statewide Intelligence Center, identified by DOJ as a fusion-centre capability facilitating information sharing among federal, state, local and tribal government partners and other relevant sectors. (Wisconsin Department of Justice)
For major public events, organisers should coordinate suspicious-activity reporting and protective-security arrangements through the relevant police agency rather than treating generic federal material as a substitute for Wisconsin/local coordination.
Wisconsin DOJ — Statewide Intelligence / Fusion-Centre Context
Homeland Security / Intelligence Resource.- Authority
- Wisconsin Department of Justice.
- Classification
- Homeland Security / Intelligence Resource.
DOJ's organisational information identifies the Wisconsin Statewide Intelligence Center and its information-sharing role. This can be relevant to major-event threat information, suspicious-activity reporting and critical-infrastructure protection. (Wisconsin Department of Justice)
State Event Permits

DNR publishes a participant-based application-fee structure beginning at $50 for events up to 100 participants and increasing for larger events, with additional costs possible depending on the proposal. (Wisconsin DNR)
Wisconsin DOA Bureau of Building Management
State-Facilities Government Resource.- Authority
- Wisconsin Department of Administration.
- Classification
- State-Facilities Government Resource.
DOA manages state facilities and works with State Capitol Police on public use of relevant state property. Event organisers proposing activity at the Capitol or other DOA-managed facilities should use this state-property process in addition to any local approvals. (DOA)
State Facility Use Permit Application
State-Property Event Permit.- Authority
- Wisconsin Department of Administration / Wisconsin State Capitol Police.
- Classification
- State-Property Event Permit.
The application requests location, dates, set-up/teardown times, proposed use, marching information, equipment, crowd estimate, and insurance/bond information. It states that applications should be received at least 72 hours before the event, with applications typically processed within ten business days. It demonstrates that state-property approval does not replace municipal approvals; the form specifically requests a City of Madison permit where applicable to certain event activity. (DOA)
State Parks and Public Lands
DNR Commercial Use on State Properties
Commercial-Use Permit.- Authority
- Wisconsin Department of Natural Resources.
- Classification
- Commercial-Use Permit.
Commercial activities on DNR-managed property can require separate permission. Event operators charging fees, selling goods/services or conducting commercial activity on state property should check commercial-use requirements in addition to the special-event permit.
Wisconsin State Park Rules and Permits

Provides Wisconsin vessel-registration rules and exemptions. The state materials include circumstances involving vessels temporarily present for authorised races, making the page relevant when organising competitive boating activity. (Wisconsin DNR) Official source https://dnr.wisconsin.gov/permits/registrations/boat/GenInfo.html ↗ Waterfront events should separately assess water-rescue capability, public access, temporary structures, navigation impacts and any DNR waterway permit triggered by physical works.
Aviation and Drone Considerations
Federal FAA requirements remain the principal aviation framework and are not reproduced here. Wisconsin does, however, impose genuine property-specific restrictions affecting drones on some state lands.

- State-Land Rule / Drone Guidance.
DNR identifies restrictions on operation of unmanned aircraft in specified Wisconsin state properties under the applicable state-park rules. Event organisers using drones for photography, security or production on DNR-managed land must therefore check property-specific state restrictions as well as FAA requirements. (Wisconsin DNR)
Incident Reporting and Accident Investigation
Wisconsin has several activity-specific reporting obligations rather than one generic event-accident reporting system.
Amusement-ride incidents can trigger DSPS reporting under SPS 334. Fire departments have statutory/administrative fire-incident reporting requirements: DSPS states that SPS 314.01(11) requires all fires to be reported through the applicable state/national incident-reporting system within the prescribed period. (DSPS)
Serious workplace incidents involving private employers may separately engage federal OSHA reporting rules. Pyrotechnic, structural or public-safety incidents can also require notification to the applicable fire, building, police or licensing authority depending on circumstances.
DSPS Fire Prevention — Fire Incident Reporting
Mandatory Reporting / Government Resource.- Authority

- Classification
- Mandatory Reporting / Government Resource.
Provides Wisconsin fire-incident reporting requirements and links them to SPS 314. This is relevant after event fires, tent fires, cooking incidents or other reportable fire occurrences. (DSPS)
Insurance and Liability
There is no evidence of a universal Wisconsin statute requiring every public event to maintain the same level of event liability insurance. Insurance requirements are instead activity- and permit-specific.
Two concrete state examples are significant. Regulated amusement rides must carry the liability insurance required under SPS 334, including the minimum levels identified by DSPS. Licensed private-security agencies are subject to statutory financial-security/liability requirements. State-property permit applications can also require evidence of insurance or a bond depending on the proposed use.
Local special-event, street-use, park or alcohol approvals can impose additional insurance and indemnification conditions. Those local conditions should not be represented as statewide statutory requirements.
County and Municipal Authority — The AHJ Layer
Wisconsin events have a strong local regulatory layer. This is one of the most important conclusions for the reference page.
Depending on venue and activity, the relevant AHJs may include the municipal fire department/fire marshal, municipal building inspector, county or municipal health department, police department or county sheriff, public works/highway authority, municipal clerk/alcohol licensing authority, zoning/planning department, parks department and local special-events office.
Matters commonly controlled or materially affected locally include special-event approval, street closures, parade permits, temporary traffic orders, fire inspection, tent approval, temporary-use approval, local building permits, food inspection where an agent health department has jurisdiction, police deployment, EMS conditions, noise, local fireworks permits, alcohol licensing, sanitation conditions and use of local public property.
The state page should therefore expressly warn users:
State compliance does not equal local event approval. An organiser should identify the AHJ at the beginning of planning and determine whether state review is performed directly by DSPS or through a delegated municipality. DSPS itself states that delegated municipalities may conduct commercial-building review and inspection and that local permits may still be required. (dsps.wi.gov)
Wisconsin-Specific Additional Issue — Wedding and Event Barns
Repurposed agricultural buildings are particularly important in Wisconsin because barns and similar rural buildings are widely used for weddings and public events.
DSPS — Use and Occupancy of Repurposed Agriculture Buildings / Wedding and Event Barn Information
Official Building-Code Guidance.- Authority
- Wisconsin Department of Safety and Professional Services.
- Classification
- Official Building-Code Guidance.
DSPS explains that where a repurposed agricultural building is used as a public building or place of employment, Wisconsin commercial-building-code requirements can apply. The guidance also discusses temporary use through the municipality and specifically tells operators to check local requirements such as zoning and liquor licensing. Although the publication originated before the current 2021-code adoption, DSPS continues to publish it through its current Commercial Buildings programme; current SPS 361–366 should therefore be used for the operative code provisions.
Wisconsin-Specific Additional Issue — Tribal Jurisdictions
Wisconsin events on land under Tribal jurisdiction require separate jurisdictional analysis. State statutes and administrative codes should not be assumed automatically to govern activities on tribal trust land in the same way as elsewhere in Wisconsin. Depending on the location and activity, tribal law, federal law, tribal regulatory authorities and particular state-law provisions may interact.
For an event on or associated with Tribal land, organisers should establish the land status and contact the Tribal Nation's own government/regulatory authorities before relying upon the state framework described above.
Overall Wisconsin Regulatory Position
Wisconsin is best understood as a layered regulatory state rather than a single-event-permit state. The most operationally significant statewide regimes for crowd and event professionals are DSPS fire prevention and commercial-building regulation; local fire/building AHJs; DHS EMS regulation; DATCP temporary-food licensing; municipal alcohol licensing under Chapter 125; DSPS private-security regulation; DSPS amusement-ride regulation; Wisconsin fireworks/explosives law; WisDOT controls where state highways are affected; WEM emergency-management structures; and property-specific permits for DNR and other state lands.
The three Wisconsin points most likely to cause errors in an event-safety reference are: treating the DOJ State Fire Marshal as the ordinary building/fire-code permitting authority; assuming Wisconsin simply applies an unmodified current IFC statewide; and assuming compliance with state requirements removes the need for municipal or county permits. The official sources show that all three assumptions would be unsafe. (Wisconsin Department of Justice)
